Summaries of Police Board Cases Decided in January 2009
Below are summaries of the Police Board’s decisions of cases in which the Superintendent of Police filed charges against a Department member (the Respondent) recommending that the Respondent be discharged from the Chicago Police Department. See Article V of the Department’s Rules and Regulations for the Rules of Conduct, the alleged violation of which forms the basis for the charges; see the Police Board’s publication Allegations of Police Misconduct: A Guide to the Complaint and Disciplinary Process for a detailed description of the Board’s handling of disciplinary cases.
Police Board Case No. 07-2645
The Police Board ordered the Respondent discharged from her position as a police officer. The Board found the Respondent guilty of violating Rules 2 and 47, in that:
- From in or around 2002, to the date the charges were filed, or for some period of time therein, the Respondent fraternized and/or maintained an association with an individual convicted of one or more felonies.
The Board found the Respondent not guilty of one count of violating Rules 2 and 41, in that:
- The Superintendent did not prove by a preponderance of the evidence on or about March 24, 2005, the Respondent disclosed information to an individual regarding a covert narcotics investigation being conducted by the Chicago Police Department in and around one or more buildings located at or near 2310, 2330, and/or 2450 South State Street, Chicago.
Police Board Case No. 08-2686
The Police Board ordered the Respondent discharged from his position as a detention aide. The Board found the Respondent guilty of violating Rules 2 and 6, in that:
- On or about May 30, 2003, the Respondent disobeyed a direct order to report to the Department’s Random Drug Testing Unit and provide a urine sample as part of his enrollment in the Personnel Concerns Program.
Police Board Case No. 08-2693
The Police Board ordered the Respondent discharged from his position as a police officer. The Board found the Respondent guilty of violating Rules 1, 2, 6, 8, 9, and 14, in that:
- On or about June 15, 2005, while on duty and inside a Target store at 2939 West Addison Street, Chicago, the Respondent without justification struck an arrestee about the head, grabbed him by the neck, and pushed him against a wall and onto a chair.
- On or about June 15, 2005, while on duty and inside a Target store at 2939 West Addison Street, Chicago, the Respondent attempted to obtain and/or have destroyed incriminating evidence.
- On or about July 17, 2007, the Respondent provided to the Independent Police Review Authority a false account of the June 15, 2005, incident, in that he denied that he attempted to obtain and/or have destroyed incriminating evidence.
